Terms of Use

This e-shop/ website belongs to and is operated by Sergakis Design Hellas Single Member Private Company, a company registered at the local Chamber of Commerce under General Electronic Commercial Registry (G.E.MI) Number 150444401000 (hereinafter the Company). The present terms and conditions of sale shall apply to any person(s) visiting the website / e-shop with the intention to browse or buy products (hereinafter the Customer) from the website yannissergakis.com (hereinafter the Website).

The terms and conditions of sale and services are available on yannissergakis.com and can be amended and/or updated at any time without prior notice, thus, you are advised to check the Terms of Use & Service from time to time for any updates or changes that may impact you. The terms and conditions also apply at the date of your order. By entering and using this website you, as a Customer, agree on and you are bound by the Terms & Conditions of Use. The Company cannot be held liable for charges you may incur by your internet provider or browser for accessing our website.

By entering our website, you confirm that you are over the legal age of majority in your country and that you are fully authorized to use a payment card to pay for your order.

Orders

When you place your order and your payment has been successfully processed, we will send you a confirmation email, including your invoice in Euros and a courier reference number so that you can track your order. Your order will be dispatched complete with a hard box, which will keep your jewellery safe, a branded guarantee and additional wrapping paper or carrying bag, if requested at the time of ordering. Once your order is received by us, we aim to dispatch it within one business day (except for public holidays or circumstances beyond our control). Once your order has been picked up by our courier partners, they will also get in touch to let you know your order is on its way. Depending on the destination, delivery might take between two to five business days. In case of delays, please notify us and we will take the issue up directly with the courier company. If your order is delayed, for reasons beyond our control, for over than ten business days, you have the right to cancel your order, in which case we will refund you the full cost of your order. In cases of force majeure or unforeseeable circumstances being at play, the Company cannot be held in any way liable by the Customer, for being unable to process, fulfill, ship or deliver your order. Force majeure events are considered (without this list being exhaustive): fire, flood, earthquakes, other natural disasters, terrorist attacks, lack of raw material, local or country-wide lock-downs, strikes, civil unrest etc.

 

Prices

Prices on this website are quoted in Euros and include VAT charges. Prices do not include procedural, delivery or special packaging fees. Prices also exclude any other fees that might come as a result of additional requests on the part of the Customer. In any case, all charges the Customer will be called upon to pay, will be shown in a summary table, before the Customer completes the order. The Company reserves the right to alter prices to reflect changes in commercial strategy or market conditions, material prices etc.

 

Payments

You can pay your order by using most debit and credit cards (Visa, MasterCard, Diners Club, AMEX, UnionPay) of major banks, through your PayPal account or by bank account transfer. Once your payment has been processed and received by us, we will notify you by email and confirm your order. The Company uses secure financial transaction systems in collaboration with official financial institutions.

Shipping

Enjoy Free shipping on all e-shop items for deliveries within the EU Customs Union countries. You can view this list here. All our deliveries are handled by DHL and normally take 2-5 business days depending on the final destination point. As the deliveries are handled by external partners, delivery times are just estimations and, therefore, cannot be guaranteed by the Company. Please note that we cannot ship to P.O. BOX addresses. Our jewellery leaves our hands in pristine condition and we make every effort so that you receive them in the same condition. If, however, there is obvious damage upon delivery, please refuse to accept the delivery and notify us immediately. Please also try to take a photo of the damaged package, if possible. We will subsequently contact our courier partners to investigate and inform you of the next steps.

 

Returns & Refunds

You have the right to return the item(s) you bought through this e-shop within 14 calendar days from the date you receive your order. If you change your mind and decide to return your item(s) to us and in order to make it easier to ascertain the exact date you received your order, please keep your delivery receipt documentation, as we might request a copy.

To arrange for a return, please notify us by email (so that we know that we are expecting a returning item), then simply contact your local DHL office and state that you need to arrange for a return to the following address:

Kindly please note that you, the customer, will have to bear the courier costs for the returned item(s).

 

Please remember to include the original purchase receipt inside the box, together with the certificate of authenticity.

When we receive and inspect the returned item for wear & tear and if we deem it to be in pristine condition, we will immediately authorize a full refund. All returned items must be unworn, undamaged and in their original packaging with all tags, labels and stickers intact. If one of these conditions are not met, you will not be eligible for a refund and the item(s) will be sent back to you. You will be required to pay for the costs of sending the item(s) back to you.

The funds for the refund will be processed in the same way as the one originally used by you for the initial purchase of the item(s). Please allow enough refund processing time between banking institutions until you see a credit notification in your account. Please note that return costs will be deducted from the refund amount you are due back.

Returned items cannot be replaced or exchanged with other items. Should you wish to buy another item through our e-shop, a new order must be placed and a new payment must be made.

The Company shall not under no circumstances be held legally liable or responsible for any damage, expense or request for compensation on the part of the Customer, in case of a delay of delivery of item(s) bought through this e-shop. Delivery times are estimations provided by external partners and, therefore, cannot be guaranteed.

 

Cancelling your order

You can cancel your order if you change your mind, by contacting us at eshop@yannissergakis.com, stating that you wish to cancel your order. If your order has not been dispatched yet, we will authorize a full refund to you (banking and administrative charges may apply, in which case they will be deducted from the final amount with which you will be refunded). If your order has already been dispatched, we will try our best to locate it and ask for it to be returned. If this is not possible, you will have to wait to receive the shipment and subsequently arrange for it to be sent back to us (see information on section Returns & Refunds). Return costs will be deducted from the refund amount you are due back.

 

Repairs

Our jewellery leaves our hands in pristine condition but as they are all handmade items, it is possible that some natural wear might occur over time. To cover all eventualities, we offer a 6-month free return and repair service, if your item loses its original shape or appearance, due to craftsmanship or original material issues. This 6-month period is calculated from the date shown on the purchase receipt of the item(s). For repairs due to other damage or mistreatment or mishandling of the jewellery, please refer to section Returns & Refunds for information. In this case, all shipment and return costs will be covered by you (the Customer). The present policy covers only the items purchased through this e-shop.

 

Jewellery Maintenance Tips

Please refrain from bringing your jewellery in direct contact with perfumes, lotions, sprays and other cosmetics that can potentially damage them. Do not use harsh cleaning agents to clean your jewellery for example alcohol, bleach, ammonia etc. If you feel the need to clean your jewellery, use some mild soap with warm water and a soft cloth. Do not put any form of pressure on the jewellery as by doing so, you will most definitely damage them beyond repair. Remember to store your jewellery away from extreme weather and temperature conditions, always in their original box or a protective pouch to safeguard against accidental damage.

Personal Data Protection

In order to make purchases on our website, you will be required to provide your personal details. In particular, you must provide your real name, phone number, e-mail address and other requested information as indicated. Furthermore, you will be required to provide complete and true personal, payment and delivery information for orders placed through our site. This information will in no way be disclosed, transferred, or sold to a third party unless imposed by a Public Authority (court, etc.).

The information our Company collects on you through this site, and for the purposes or accepting, processing, fulfilling and dispatching your order are the following: Name, Surname, Telephone Number, E-mail Address, Order Address, Payment Address, Delivery (Dispatch) Address, Town, Province, Region, Country, Post Code. Please note we do not, in any way, save or store your payment details.

Legal Information

These terms and conditions are to be construed in accordance with the laws of Greece and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the courts of Athens, Greece.

For disputes with consumers who are EU residents we propose out-of-court dispute resolution through the ODR (Online Dispute Resolution) platform. According to EU Regulation 524/2013, the EU resident consumer can appeal to the platform and lodge a complaint against the trader. The platform notifies the trader and either the parties communicate directly with each other in order to find a solution or the trader proposes a dispute resolution body which will take over the communication between the parties. Accordingly, the trader may resort to the platform and lodge a complaint against the consumer if the consumer resides in Germany, Belgium, Luxembourg or Poland (and in those Member States which draw up a list of ADR entities in the future.
